NO PURCHASE OR DONATION NECESSARY TO ENTER OR WIN THIS RAFFLE. THE COASTAL CONSERVATION ASSOCIATION MARYLAND YEAR END KAYAK RAFFLE(“RAFFLE”) BEGINS AT 12:00 AM EASTERN TIME (“ET”) ON 12/14/22 and ENDS AT 4:00 PM ET ON 1/22/22 (“ENTRY PERIOD”).
ELIGIBILITY: Raffle is open only to legal residents of the 50 United States and the District of Columbia, age 18 years or older at time of entry (referred to hereafter as “you” and/or “Entrant”). Subject to all applicable federal and state and local laws and regulations. Void where prohibited by law. Employees and their immediate families (parents, children, spouse, siblings) of the Coastal Conservation Association Maryland (“the Sponsor”), its affiliates, subsidiaries, sales representatives and/or distributors, and all other companies involved with the development or execution of this raffle (collectively referred to “Released Parties’) and their immediate families, advertising and promotion agencies and those living in the same household of each (whether related or not) are not eligible to enter.
HOW TO ENTER: During the Raffle Entry Period, visit the URL indicated on the offer and follow all entry instructions to make a donation and enter the raffle. You are automatically entered in the raffle random drawing based on your donation amount and the number of tickets received according to the information posted at: https://www.ccamd.org/product/kayak-raffle-2022/. Or, to enter the raffle without making a donation, hand print your name, complete address, phone number and email on a postcard and mail postcard to: CCA Maryland 2022 Year End Raffle P.O. Box 309 Annapolis, MD 21404. Postcard entries must be mailed separately and must be postmarked by 1/15/22 and received by 1/20/22. Each postcard entry will grant one raffle ticket.

All prize details are at Sponsor’s sole discretion. No substitution or transfer of any prize is permitted. Prizes may not be redeemed for cash value or exchanged for another prize, except by Sponsor who reserves the right in its sole discretion to substitute any prize for another prize of comparable or greater value. Each winner acknowledges that the Sponsor and all other businesses concerned with this raffle and their agents do not make, nor are they in any manner responsible for any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of any prize except that each prize shall be subject to the manufacturer’s standard warranty, if any.
WINNER SELECTION and NOTIFICATION: A random drawing will be conducted on 1/22/22 from all eligible entries received during the Entry Period. Random drawing conducted by the Sponsor’s agent (“judges”) whose decisions are final and binding in all respects. The potential winner will be announced on 1/22/22 and notified via email, phone call, mail and/or courier within 3 business days after random drawing. In order to receive a prize, at Sponsor’s discretion, each potential winner will be required to complete an Affidavit of Eligibility and Release of Liability which must be signed and returned (along with any other documentation the Sponsor reasonably requires for prize fulfillment, such as, but not limited to, providing proof of identity) within 5 days of date printed on notification or the potential winner will be disqualified and an alternate winner will be determined. Grand Prize Winner will also be required to furnish his/her taxpayer identification number information by completing and submitting a W-9 Form before the awarding of any prize to comply with IRS tax reporting requirements. If a potential winner fails to respond within 5 days, or if notification is returned as undeliverable, that potential winner will be disqualified and an alternate will be determined. Prizes shall be picked up at the Chesapeake Bay Boat Show on Sunday 1/22/22 located at Maryland State Fairgrounds 2200 York Road Lutherville-Timonium, MD 21093 or by arranging for shipping or delivery by CCA Maryland staff. Winner will be responsible for any shipping costs. Guided fishing trip to be taken during the 2023 calendar year on mutually agreeable dates.
GENERAL: By participating in the Raffle, each Entrant (i) agrees to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor and the judges, which are final and binding in all matters relating to the Raffle. Except where prohibited by law, entry and acceptance of prize constitute permission to use each winner’s name, photograph, hometown, likeness, and prize won (all at Sponsor’s discretion) for future advertising, publicity in any and all media now or hereafter devised throughout the world in perpetuity, without additional compensation, notification, release, or permission. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Raffle or in the announcement of any prize or for any suspension of the Raffle or inability to implement the Raffle or award the prizes as contemplated herein due to any event beyond its control, including delays or interruptions caused by acts of God, acts of war, natural disasters, weather, utility outages, acts of terrorism or any federal, state, or local government law, order, or regulation, order of any court or regulator. Sponsor reserves the right to take action to: (i) permanently disqualify from any Raffle it sponsors any person it believes has intentionally violated these Official Rules; (ii) suspend the collection of entries if the Raffle becomes unfairly impaired in any way and to select winners from among all eligible entries received prior to such action. This Raffle shall be governed by and interpreted under the laws of the State of New York, U.S.A. without regard to its conflicts of laws provisions. Any and all disputes, claims, and causes of action arising out of or in connection with this Raffle, shall be resolved individually, without resort to any form of class action. RELEASE: Entrants on their behalf, and on behalf of their respective heirs, executors, administrators, legal representatives, successors and assigns (“Releasing Parties”), release, defend and hold harmless Sponsor, any entity involved in the fulfillment of the prizes or the administration of the Sweepstakes, and their respective employees, officers, directors and agents of each (“Released Parties”), from any and all actions, causes of action, suits, debts, dues, sums of money, accounts, reckonings, bonds, bills, specialties, covenants, contracts, controversies, agreements, promises, variances, trespasses, lost profits, indirect or direct damages, consequential damages, incidental damages, punitive or exemplary damages, judgments, extent, executions, claims and demands whatsoever, in law, admiralty or equity, whether known or unknown, foreseen or unforeseen, against Released Parties which any one or more of the Releasing Parties ever had, now have or hereafter can, shall or may have which in any way arise out of or result from entrant’s participation, acceptance and use or misuse of any prize won, including property damage, personal injury or death. By participating in this Raffle, each entrant expressively waives and relinquishes all rights and benefits afforded by California Civil Code 1542 and does so understanding and acknowledging the significance of this waiver. Section 1542 states as follows: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DID NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN, BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR THE RELEASED PARTIES.”
